Terms of Service

1. Introduction

These Terms of Service govern your use of Nivern's proxy watch purchasing services. By engaging our services, you agree to be bound by these terms. Nivern is based in Japan and acts as a purchasing agent on your behalf to source watches from dealers, boutiques, and collectors within Japan.

2. Services Described

Nivern provides proxy purchasing services, meaning we purchase watches on your behalf from sources within Japan. We are not a watch dealer, reseller, or retailer. Our service includes:

• Sourcing specific timepieces based on your requirements
• Negotiating with dealers and sellers on your behalf
• Verifying authenticity and documentation in person
• Handling secure payment and international shipping logistics

3. Pricing and Payment

Our service fee is calculated as a percentage of the watch's purchase price, tiered as follows:

• Watches under $5,000 USD: 7% service fee
• Watches $5,000 – $15,000 USD: 5% service fee
• Watches $15,000 USD and above: 3% service fee

A minimum service fee of $100 USD applies to all orders.

Payment terms are structured as follows:

• Full deposit of the watch price plus service fee is required before we proceed with purchase
• Shipping costs are calculated separately based on your destination and preferred shipping method
• Customer is responsible for all shipping costs

All prices are quoted in USD unless otherwise specified. Exchange rate fluctuations are calculated at time of purchase.

4. Sourcing Timeline

Sourcing times vary depending on watch availability and market conditions. Estimated timelines provided are good-faith projections based on current availability but are not guaranteed. Some pieces may take longer than initially estimated, particularly vintage or rare references, and we will communicate any significant delays promptly.

5. Deposits and Cancellations

Full payment (watch price plus service fee) is required before we proceed with any purchase. This ensures commitment and allows us to move quickly when opportunities arise.

Cancellation policy:

• Cancellation before we locate your watch: Full refund of deposit minus administrative fee of $50 USD
• Cancellation after we locate but before purchasing: Service fee is non-refundable, watch price deposit returned
• Cancellation after purchase is made: No refund available

If we are unable to source your requested piece within a mutually agreed timeframe, you may request a full refund of your deposit.

6. Authenticity and Warranties

All watches sourced through Nivern are verified in person before purchase. For new watches, we ensure:

• Complete documentation including warranty cards and receipts
• Visual and physical inspection before purchase
• Confirmation of retailer legitimacy

For vintage watches, we provide detailed photos, condition reports, and verify authenticity to the best of our ability. Vintage pieces are sold as-is regarding condition.

Manufacturer warranties for new watches remain with the point of purchase. Nivern does not provide additional warranty coverage beyond what is offered by the manufacturer or original seller.

7. Shipping and Delivery

All shipments are fully insured for the declared value of the watch. Shipping options and costs are quoted based on your destination country and preferred method.

Customer is responsible for:

• All shipping costs from Japan to destination
• Import duties, taxes, and customs fees in your country
• Providing accurate shipping address and contact information

We will provide accurate customs documentation. Once a package is handed to the shipping carrier with proper insurance, risk of loss transfers to the carrier until delivery is confirmed.

8. Limitation of Liability

Nivern's liability is limited to the service fees paid for the specific transaction in question. We are not liable for:

• Market value fluctuations of purchased timepieces
• Delays outside our control (customs, shipping carrier issues, natural disasters)
• Issues arising from vintage watch condition not apparent at time of inspection
• Indirect or consequential damages

9. Disputes

Any disputes arising from these terms or our services shall be resolved through good-faith negotiation. If resolution cannot be reached, disputes will be subject to the jurisdiction of the courts of Japan, and Japanese law shall apply.

10. Privacy

Your personal information is handled in accordance with our Privacy Policy. By using our services, you consent to the collection and use of information as described therein.

11. Modifications

We reserve the right to modify these terms at any time. Changes will be posted on this page and take effect immediately upon posting. Continued use of our services after changes constitutes acceptance of the modified terms.
